Mr. Nick Alfieri’s Agent’s Report has been appended to the minutes.

GENERAL BUSINESS

Minor Buffer Zone Activity:  85 Elm Street
The applicant has requested to rebuild a deck with 12” footings off the side of his house.

There was a motion to issue a Negative Determination subject to 5 conditions; that the applicant  notify the Agent before he commences work, that he conduct the work according to the plan, that he remove the existing footings by hand, that he notify the Agent when the work is completed, and any soil remaining to be removed.  The motion was seconded and accepted with a vote of
7-0-0.

Enforcement:  405 King Street
The Commission Chairman stated that a site walk was recently conducted and there was a quorum.  The Commission gave Mr. Raymond Lavallee, the applicant, some direction for the restoration.  It was observed by a Commission member that the grading has been completed and wood chips put down.

There was a motion to approve the agreement dated April 12, 2012 between the Commission and Mr. Lavallee with 2 minor spelling corrections.  The motion was seconded and accepted with a vote of 7-0-0.

Enforcement:  860 West Central Street
Mr. Alfieri informed the Commission members that on Monday, April 9th, Mr. David McKearney, the  Health Director, informed him that a sewer manhole was surcharging at the Incontro Restaurant and effluent was going into the stream.  Mr. Alfieri visited the site.  Clean Harbors was called to pump it out.  He spoke with the owner of the mill, Mr. Leonard French, and it was cleaned up.  The next day Mr. Alfieri visited the site and it was cleaned up.

An Enforcement Order and letter was sent to Mr. French requesting him to appear at the next meeting and to clean up the site.  Also requested was an O&M plan and written verification that this was done according to the plan.

There was a motion to ratify the letter and Enforcement Order.  The motion was seconded and accepted with a vote of 7-0-0.

Enforcement:  39 Peck Street
Mr. Alfieri informed the Commission members that the homeowner was found to be cutting trees in Conservation jurisdiction and on Conservation property without a permit.  

The Commission will conduct a site walk of the property on Sunday, April  15th at 9 a.m.

Mr. Alfieri has issued an Enforcement Order to the homeowner.

There was a motion to ratify the Enforcement Order for 39 Peck Street.  The motion was seconded and accepted with a vote of 7-0-0.

Enforcement:  31 Peck Street
Mr. Alfieri informed the Commission members that the homeowner was found to be cutting trees in Conservation jurisdiction and on Conservation property without a permit.

The Commission members will conduct a site walk of the property on Sunday, April 15th
at 9 a.m.

Mr. Alfieri has issued an Enforcement Order to the homeowner.

There was a motion to ratify the Enforcement Order for 31 Peck Street.  The motion was seconded and accepted with a vote of 7-0-0.

Permit Decision:  Prospect Street – Town of Franklin – DPW - CE159-1030
There was a discussion among the Commission members regarding the issuance of Orders of Conditions for this project.  Mr. Alfieri has provided the Commission with 51 proposed special conditions included in the Agent’s Report.

There was a motion to issue State and Local Orders of Conditions for Prospect Street with 51 special conditions.  The motion was seconded and accepted with a vote of 6-0-1; 6 Yes, 0 No,
1 Abstention.



Certificate of Compliance:  20 Winthrop Drive - SE159-490 & SE159-437
Mr. Alfieri informed the Commission members that the work was conducted in accordance with the plan and recommended that the Commission issue 2 Certificates of Compliance.

There was a motion to issue 2 Certificates of Compliance for 20 Winthrop Drive.  The motion was seconded and accepted with a vote of 7-0-0.

Certificate of Compliance:  20 Crystal Pond Lane – SE159-498
Mr. Alfieri informed the Commission members that he has inspected the property and the work was conducted in accordance with the plan.  There is a vernal pool located in the yard.

There was a motion to issue a partial Certificate of Compliance for 20 Crystal Pond Lane.  The motion was seconded and accepted with a vote of 6-0-1; 6 Yes, 0 No, 1 Abstention.

Discussion:  Eagle Scout Project
The Commission Chairman informed the members that an Eagle Scout has requested suggestions for an Eagle Scout project.  Some suggestions were:

  • An Indian Rock loop trail, and
  • A sign at the Town Forest on Summer Street.  
Mr. Alfieri will contact the Eagle Scout to inform him of the above suggestions.

Discussion:  Conservation Web Site
The Commission Chairman requested feedback for Mr. Alfieri from the members on his work on the Conservation website.  The Commissioners will look at the site and get back to him at a future meeting with suggestions.

One comment was that the Agent’s Reports should be posted as they are part of the minutes.

There was a motion to adjourn.  The motion was seconded and accepted with a vote of 7-0-0.
